CFTC RULE 4.41

Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profit or losses similar to those shown.

BACKTESTS ARE HYPOTHETICAL

Historical tests use reconstructed prices and modeled costs. They are not a live account. Spreads, commissions, slippage, and gaps can be worse than the model. A hold-out window does not make a backtest real.

FORWARD TESTS ARE STILL A SAMPLE

The public ledger is a sample of a forward book. It can be incomplete, delayed, or revised if a fill is corrected. It is not an audited track record and not an offer of managed capital.

PROP-FIRM AND FUNDED LANGUAGE

References to prop-firm or funded accounts describe a constraint I use after forward testing. They are not an affiliation, a pass guarantee, or a solicitation to buy a challenge.
